Terms of service

About these Terms

These Terms apply when you use kinfusion.co.uk and buy products through it. The website is operated by KIN FUSION LIMITED, trading as Kin Fusion Design Studio (“we”, “us” or “our”). Shopify provides the ecommerce platform; your sales contract is with KIN FUSION LIMITED. By placing an order, you agree to the Terms that apply to it. Nothing here removes or reduces your rights under UK consumer law.

Our details

KIN FUSION LIMITED is registered in Scotland, company number SC777414. Registered office: 7 Spowart Drive, Dunfermline, United Kingdom, KY12 9FP. Email: willie@kinfusion.co.uk. We are not VAT registered.

Products and descriptions

We take care to describe and show products accurately. Colours can vary slightly between screens and small differences in garment or print appearance may occur. These variations do not affect your legal rights. Goods must still be as described, of satisfactory quality and fit for any particular purpose made known to us and accepted by us. Any defect specifically drawn to your attention before purchase and accepted by you forms part of the description.

Orders and payment

Submitting an order is an offer to buy. The contract is formed when we email you confirming acceptance. We may decline an order before acceptance, for example if an item is unavailable, a pricing or listing error has occurred, or payment cannot be verified. If we have taken payment for an order we do not accept, we will refund it. Please check your order and address before submitting. Contact us promptly if you need a change; we will try to help but cannot guarantee changes after preparation or dispatch begins.

Prices are in pounds sterling (GBP). We are not VAT registered and do not charge VAT. Delivery costs and any other charges are shown before you place your order. Payment is due at checkout using the methods displayed there.

Delivery and risk

Available delivery methods, charges and estimated times are shown at checkout or in your order confirmation. Unless we agree another time, we will deliver within 30 days after the contract is made. If delivery is late, your legal rights include giving us an appropriate further period and, in circumstances provided by law, ending the contract and receiving a refund.

Where we arrange delivery, goods remain at our risk until they come into the physical possession of you or someone you nominate to receive them. If you independently arrange a carrier that we did not offer, risk may pass when we hand the goods to that carrier, as permitted by law. Carrier loss or delay does not remove our responsibilities under consumer law. Ownership passes to you when we receive full payment.

Cancellation, returns and faulty goods

If you are a consumer buying online, you can usually cancel within 14 days after the day you, or someone you nominate (other than the carrier), receive the goods. Tell us clearly by email at willie@kinfusion.co.uk. You then have a further 14 days to return them. For a change-of-mind cancellation, you pay the direct return cost, unless we have agreed to pay it or the law requires us to pay (including where the goods are faulty, incorrect or do not conform to the contract).

You may handle goods as needed to establish their nature, characteristics and function, as you could in a shop. If you handle them beyond that, we may make a lawful deduction for resulting loss in value. We will not charge an automatic cancellation or restocking fee. Following statutory cancellation, we refund the payments due, including the cost of our least expensive standard delivery option, no later than 14 days after we receive the goods back or, if earlier, evidence that you sent them back. Refunds go to the original payment method unless you agree otherwise.

The statutory change-of-mind right does not apply to goods made to your specifications or clearly personalised where the law provides that exception. It does not affect your rights if those goods are faulty or do not conform to their description.

Our Refund Policy may offer an additional voluntary return option. Its conditions apply only to that additional option and do not restrict statutory cancellation rights or rights concerning faulty, damaged, incorrect or non-conforming goods.

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you may have rights to reject them, request repair or replacement, or receive a price reduction or refund, depending on the circumstances and legal time limits. Contact us and we will work with you to resolve the issue. Nothing here limits your statutory remedies.

Website use and intellectual property

Unless stated otherwise, our original designs, photographs, graphics, text, branding and logos are owned by KIN FUSION LIMITED or used with permission. You may browse the website for personal, non-commercial use. You must not copy, adapt, distribute or commercially use our content without written permission, except where the law allows. Third-party names and marks belong to their owners.

You must not use the website unlawfully, interfere with its security or operation, or upload malicious code. We may restrict access where reasonably necessary to protect the website, customers or our business.

Third-party services and website availability

Checkout, payment and other features may be provided by third parties, including Shopify and payment providers, under their own terms. Our website may link to third-party sites; we are not responsible for their content or operation. This does not affect our responsibilities for your order or your rights against us.

We aim to keep the website available and accurate, but access may occasionally be interrupted for maintenance or reasons outside our control. This does not limit your rights relating to products bought from us.

Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot be excluded, statutory consumer rights, or any liability the law does not allow us to exclude or limit.

If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that is not foreseeable or not caused by our breach. You retain all rights the law provides.

Changes to these Terms

We may update these Terms by posting a new version here. The version in force when you order applies to that order unless a change is required by law or we agree otherwise.

Governing law and contact

These Terms are governed by Scots law. If you are a consumer living elsewhere in the UK, you retain any mandatory protections and rights to bring proceedings that apply where you live.
